Elon Musk cofounded OpenAI back when it was a non-profit with lofty ideals about democratizing AI. Then he got passed over for the CEO gig, threw a fit, and walked. Sam Altman stayed, took the reins, and turned OpenAI into a for-profit juggernaut worth billions. Now Musk is back with a lawsuit, and a trial is scheduled to start in Oakland, California, on April 27th.
On paper, this is a legal case about whether OpenAI defrauded Musk. But let’s be real: that’s not what this is about. This is about mess. Two of the most powerful, thin-skinned men in tech are about to air their dirty laundry in front of a jury, and the rest of us get to watch.
Over the past couple of years, Musk’s legal theories for punishing OpenAI have run the gamut from breach of contract to unfair business practices to false advertising. He’s tried everything short of accusing Altman of stealing his lunch money. The core complaint? That OpenAI abandoned its original non-profit mission and sold out to Microsoft. Which, yeah, they did. But Musk also wanted to merge OpenAI with Tesla and run it himself, so his moral high ground is pretty shaky.
The timing is especially juicy. Both Musk and Altman will be called to the stand at a particularly delicate moment. Musk is busy tanking Twitter’s value and launching rockets.
