Jury selection starts today for what might be the messiest tech trial in years. Elon Musk is taking Sam Altman and OpenAI to court, and the outcome could force the company to change how it operates entirely.

Musk filed this lawsuit back in 2024. His core claim hasn’t changed: OpenAI abandoned its founding mission. When he helped start it, the idea was to build AI that benefits humanity, not to chase profits. Now he’s arguing that Altman and cofounder Greg Brockman tricked him into donating money, then pivoted to a for-profit model that made them rich.

OpenAI’s response is blunt. They call the lawsuit “a baseless and jealous bid to derail a competitor.” And honestly, it’s hard to ignore the timing. Musk’s own AI company, xAI, launched Grok as a direct competitor to ChatGPT. If he wins this case, he doesn’t just hurt OpenAI — he weakens a rival while boosting his own empire of X, SpaceX, and xAI.

Musk is asking the court to remove Altman and Brockman from their positions. He also wants OpenAI to stop operating as a public benefit corporation. On top of that, he’s demanding up to $150 billion in damages, which would go to OpenAI’s nonprofit side if he wins.

This trial has been brewing for a while. Musk dropped fraud claims just before jury selection, which is interesting. That suggests his legal team is narrowing the case to focus on breach of fiduciary duty and mission abandonment rather than personal deception. It’s a cleaner argument for a jury to understand.

The courtroom drama is already unfolding. Voir dire started with the first 20 potential jurors. Things are apparently “exciting outside” — whatever that means. I’ve been following Musk’s legal battles for years, and this one feels different. It’s not just about money. It’s about whether a company can change its founding principles without facing consequences.

If Musk wins, OpenAI would have to restructure. That could slow down their development pace and give xAI and other competitors room to catch up. If OpenAI wins, it sets a precedent that startups can pivot from nonprofit to for-profit without legal risk as long as they disclose it.

Either way, this trial is going to get ugly. Both sides have deep pockets and long memories. I’ll be watching closely.
